Former DSS Spokesman Sues FG Over Sack

The former Spokesperson of the Department of State Services (DSS) Marilyn Ogar has sued the Federal Government before the National Industrial Court of Nigeria (NICN) over her termination from Office..

The case comes up today Thursday 18, in Abuja before the NICN President Justice Babatunde Adejumo.

Ogar and others were demoted and compulsorily retired by the FG.

Those named as defendants in the suit are the Attorney General of the Federation, the State Security Service (SSS) and the Director General SSS.

Ahmed Raji SAN who filed the suit on behalf of Ogar by way of originating summons wants the court to nullify Ogar’s sack and reinstate her with all her ranks, salaries and benefits to the employment of the FG.

Ogar is further asking the Court to set aside her purported demotion from Assistant Director to Chief Security Intelligence Officer.

She is seeking a Court declaration that her employment with the SSS has statutory flavor and same may only be lawfully determined strictly in accordance with the relevant provisions of the public service Rules.

Ogar through her lawyer is asking the Court to determine whether she is a public officer and whether she can be lawfully demoted, sacked or retired by the defendants.

Daily Trust recalls that Ogar was promoted alongside 44 others in promotions that were done in the twilight of the Goodluck Jonathan’s administration.

But the Buhari administration reversed the promotions, citing irregularities and breach of extant rules guiding such actions.

Ogar reportedly earned her promotion following commendation she received from former President Jonathan for doing “a fantastic job” as spokesperson of the DSS.

An extraordinary legal fight is brewing with major privacy implications for millions of cellphone users after a federal magistrate ordered Apple Inc. to help the FBI hack into an iPhone used by the gunman in the San Bernardino mass shootings.
The clash brings to a head a long-simmering debate between technology companies insistent on protecting digital privacy and law enforcement agencies concerned about losing their ability to recover evidence or eavesdrop on the communications of terrorists or criminals.
On Wednesday, the White House quickly disputed the contention by Apple's chief executive officer, Tim Cook, that the Obama administration is seeking to force the software company to build a "backdoor" to bypass digital locks protecting consumer information on Apple's popular iPhones.
The early arguments set the stage for what will likely be a protracted policy and public relations fight in the courts, on Capitol Hill, on the Internet and elsewhere.
"They are not asking Apple to redesign its product or to create a new backdoor to one of their products," White House spokesman Josh Earnest said. "They're simply asking for something that would have an impact on this one device."
Within hours of the judge's order on Tuesday telling Apple to aid the FBI with special software in the case, Cook promised a court challenge. He said the software the FBI would need to unlock the gunman's work-issued iPhone 5C would be "too dangerous to create" and "undeniably" a backdoor.
Cook compared it to a master key, capable of opening hundreds of millions of locks, and said there was no way to keep the technique secret once it was developed.
"Once the information is known, or a way to bypass the code is revealed, the encryption can be defeated by anyone with that knowledge," Cook said.
At the center of the debate is the private information carried on nearly 900 million iPhones sold worldwide: Photographs, videos, chat messages, health records and more.
There also was swift reaction on the presidential campaign trail, where Donald Trump told Fox News that he agreed "100 percent with the courts," and on Capitol Hill, where the chairman of the Senate Intelligence Committee, Richard Burr, R-N.C., said, "Court orders are not optional and Apple should comply."
Democratic Sen. Dianne Feinstein of California, who fought encryption in the 1990s, said she thought the government should be able to access the phone. On Twitter, Edward Snowden called it "the most important tech case in a decade."
But Rep. Justin Amash, R-Mich., called the Justice Department's request "unconscionable and unconstitutional."
The ruling by U.S. Magistrate Judge Sheri Pym represents a significant victory for the Justice Department, which last year decided not to pursue a legislative fix to address encryption but has now scored a win instead in the courts.
Federal officials until now have struggled to identify a high-profile case to make its concerns resonate. But in siding with the government, Pym, a former federal prosecutor, was persuaded that agents investigating the worst terror attack on U.S. soil since Sept. 11 had been hobbled by their inability to unlock the county-owned phone used by Syed Farook, who along with his wife, Tashfeen Malik, killed 14 people in December before dying in a police shootout.
The dispute places Apple, one of the world's most respected companies, on the side of protecting the digital privacy of an accused Islamic terrorist.
"We have no sympathy for terrorists," Cook said.
Apple has provided default encryption on its iPhones since 2014, allowing any device's contents to be accessed only by the user who knows the phone's passcode. The phone Farook was using, running the newest version of Apple's iPhone operating system, was configured to erase data after 10 consecutive, unsuccessful unlocking attempts.
The magistrate ordered Apple to create special software the FBI could load onto the phone to bypass the self-destruct feature. The FBI wants to be able to try different combinations in rapid sequence until it finds the right one.
The Justice Department said it was asking Apple to help unlock only the iPhone used by Farook and owned by the county government where he worked as an environmental inspector. The judge said the software should include a "unique identifier" so that it can't be used to unlock other iPhones.
"If a court can legally compel Apple to do that, then it likely could legally compel any other software provider to do the same thing," including helping the government install tracking or eavesdropping software on a phone or laptop, said Kevin Bankston, director of the Open Technology Institute at New America.
It was unclear how readily the software might be modified to work against other iPhones, or how quickly Apple might update its own software to render the new bypass ineffective.
The next step in the case wasn't immediately clear, either. The judge gave Apple five days to contest the order as unreasonably burdensome. A magistrate judge on the lowest rung of the federal judiciary almost certainly could not establish meaningful precedent without affirmation from a higher-court judge, which means the fight is likely to proceed up the chain.
The former head of the FBI division responsible for producing some of the FBI's most cunning surveillance tools, Marcus Thomas, said Apple faces a challenge in showing that the government's request is overly burdensome. Thomas, the chief technology officer at Subsentio LLC, said companies that build ultra-secure products that might be used by criminals or terrorists can expect government requests for help.
"Society wants to know that companies aren't producing these complicated services and devices that can be used as weapons against them," he said.

Native Doctor Kills Two Brothers Seeking Bullet-proof Protection (pictured)

A NATIVE doctor in Kogi State has butchered his own customers and close acquaintances for years. Mallam Ibrahim Muhammed Dabasabe, who also claimed to be a Muslim cleric, discreetly murdered two brothers, Tanko Abubakar and Muhammed Kudu Abubakar, who both came for spiritual guidance. The two brothers from Niger State were killed by their host and their bodies buried behind Dabasabe compound.

They had visited based on their familiarity with the herbalist when he lived in their family house in Bida some years back. Though not the first time the brothers would be visiting, they had come to complain that the last consultation, which was a charm to make someone impervious to bullets and gunshots, had failed.

But they met their death after Dabasabe gave them poison, which he told the brothers would make the bulletproof charm effective. The concoction had an immediate effect on the brothers, who began to writhe in pain. When death delayed in coming, the native doctor hastened it by using a pestle to smash their skull after which he buried them in his compound.

Confessing to the murder, Dabasabe said he was confused on what next to do after collecting huge sums of money for the native bulletproof protection. “So, I decided to poison the two and used pestle to break their heads when the poison did not kill them instantly.”

Ita-Giwa Reveals - ''What Jonathan Told Me After He Conceded To Buhari''

Former Presidential Adviser on National Assembly Matters, Florence Ita-Giwa, has disclosed her conversation with ex-President, Goodluck Jonathan, during last year’s presidential election.

Jonathan, the candidate of the PDP was defeated by the incumbent President, Muhammadu Buhari of the APC.

Speaking with DAILY POST in Lagos on Tuesday, Ita-Giwa revealed her chat with Jonathan after he conceded defeat.


“I called former President, Jonathan and told him, ‘why not wait till the result is declared before conceding?’

“This was two minutes after he made the announcement.

“Responding, he said, ‘Aunty, I already know what the outcome would be. I have done the right thing. I am keeping to my word that no blood is worth my ambition.

“I said to him, ‘You are great indeed’. He thanked me for my call.”


“I don’t regret supporting him, but we thank God for the peace and unity of the country.”

Reacting to the spate of defections to the ruling APC by PDP members, the politician said she will not leave the PDP.

“You can support the President without defecting to his party. Many are doing this for what they can gain.”

“I remain in PDP but will support good policies of the present government.”

Ita-Giwa hailed the nation’s media for the resilience over the years, urging them to continue to be the voice of the people.

“You all are doing a wonderful job, let’s continue to do our best to make Nigeria great,” she added.

EFCC re-arraigns Dokpesi over alleged N2.1bn fraud

The Economic and Financial Crimes Commission EFCC today re-arraigned former chairman of DAAR communications Plc, Raymond Dokpesi before Justice John Tsoho of the federal high court, Abuja, over a six-count charge of criminal breach of public procurement law to the tune of N2.1bn, the same charges filed against him in December.

During the hearing, Dokpesi pleaded not guilty to all charges. His counsel, Wole Olanipekun, Dokpesi’s lawyer, asked the presiding judge to allow him maintain the bail he was granted by Justice Kolawole on December 14. He said his client had been of good behaviour since the bail was granted.

After listening to the counsel, the judge ruled that the bail granted Dokpesi be maintained. He adjourned the case to March 2 and 3 for commencement of trial.

Unknown gunmen have reportedly abducted Inengite Nitabai, the foster father of former President Goodluck Jonathan in Otuoke, Ogbia local government area of Bayelsa state late last night February 16th.

According to Sahara Reporters, the kidnappers stormed the home of the septuagenarian and whisked him away to an unknown destination. Bayelsa state police spokesperson, Ansim Butswat, confirmed the incident and said the police was trailing the kidnappers. Nitabai was kidnapped in 2014 and regained his freedom after the intervention of security personnel.

Central Bank of Nigeria (CBN) governor, Godwin Emefiele, may be the next top profile government official to lose his job, Ripples can authoritatively confirm.

Top presidential aides confided on Monday that the dragnet is drawing closer to Emefiele, who was appointed as head of the nation’s apex bank by former President Goodluck Jonathan on June 3, 2014.

Emefiele replaced Mallam Lamido Sanusi, the Emir of Kano, who was controversially suspended and fired by Jonathan for alleged insubordination.

But the CBN chief has been in the eye of the storm lately following revelations that the nation’s treasury was practically emptied to fund the failed re-election bid of Jonathan in 2015.

Emefiele, investigators alleged, granted government officials unfettered access to the treasury during the electioneering period and even printed new currencies when the vault was drained.

Many people expected President Muhammadu Buhari to have fired the bank’s chief following his alleged involvement in the infamous Dansukigate scandal, but a top presidential aide said Buhari decided otherwise, to strike at the best time.

'Oliseh's Youtube video was manipulated. NFF can't continue sacking coaches!' - Sports Minister

The Nigerian Sports and Youth Minister, Barrister Solomon Dalung who intervened and stopped the NFF from sacking embattled coach Sunday Oliseh after his 'insane' video rant has blasted the NFF for their incessant sacking of coaches in the past and has warned the football body that such practices won't be tolerated in the future.

 

In the long media briefing the minister also made a 'wild' assertion that Oliseh's YouTube rant was manipulated as the video was 'fluctuating' when he was watching the video. Lol!

“The decision to fix matches is the direct responsibility of the NFF not on the rectangular size of my table," Dalung said in a Tuesday media briefing in his Abuja office.. 
"I can tell you that they have already had problems with the Kaduna venue because the coach wants Port Harcourt, while the federation was insisting on Kaduna.
“When I waded into it appealing to them, the coach told me that the team is playing against many negative things but when I asked the leadership of the federation, they started the whole story about the crisis with the coach.
"But I told them they were drifting too far into the issue of sacking the coach since I was not interested in listening to their stories.
“We should be able to build a country where we should celebrate somebody that did well and sympathize with him if he fails, encouraging him to do better. I told the federation that overconfidence ruined the team.
“I told the federation that they don’t need to sack the coach because he lost a game. They brought the issue of YouTube complaining that the man embarrassed Nigerians and must apologise.
"But I told them that they should not judge him based on the YouTube because technology is now so sophisticated that a man can be manipulated having an affair with a woman when it is not true.
“Yes, I agree that I am a novice as they claimed but I looked at that video and the way it was fluctuating convinced that there was an act of manipulation. This is my own judgment and I am free to hold this opinion.
“I told them if they have not heard from Oliseh directly concerning those things on YouTube, they have to hold on until I speak to Oliseh. When I spoke to him, he did not indicate any bitterness throughout the 16 minutes the discussion lasted. He rather pointed at issues we have to address.
“I know very well the circumstances with which he trained the players and even NFF know.  I told the federation that based on the discussion, we have to look at how we can make progress out of it instead of sacking Oliseh now and bringing another person we will sack again when he loses against Egypt.
“After sacking another, we will then look at how we can sack the NFF because if we sack the coaches, we will face the people that employed them since they have also failed too. It is going to be a sack game which is what we should avoid. I told them it is natural to discipline coaches but not to sack them.”
 “If I will still be here when the elections into the board of the federations will be done, I am assuring Nigerians that nobody will pick his in-law or farmers’ association chairman as a member of a board.
“Those who are contesting must show their commitment, they must show how they will guide their federation to success.
“Most of all the problems we are having in the federations are linked to this. We have federations that are existing and cannot do anything except the ministry gives them money.
“The ministry even funds the ticket for a president [of a federation] to come for meetings. At the end of the day, you will discover that the federations have been reduced to a battle ground; nothing but fighting over relevance and resources.
“A man who was a leader of a farming group in the village will now be appointed a board member in a football federation.
"Immediately he arrives on the board, he considers himself as having been appointed into a big political office where he must be paid allowances and he must be given money, he has nothing to contribute but much is going to be spent on him.
