Oratilwe Hlongwane aka DJ Arch Junior, a three-year-old DJ who has taken South Africa and the whole continent by storm has been accused of cheating. Destiny magazine shares that e.TV publicist Michael Pocock has rubbished all the claims and assures audiences that Arch’s talent is legitimate. “The photo that has been making the rounds on social media does not show the full technical setup of DJ Arch’s performance, which took place at Soweto Theatre on the 8th of November 2015 in the finale of SA’s Got Talent,” he said also adding that the audio cables were connected via the laptop and not the controller.
“There were two laptops on the stage, which DJ Arch Jnr was consistently watching. The one laptop has the DJ software on it, which plays the songs, and the other laptop has a countdown system which cues DJ Arch Jnr. The controller in front of him has a black USB cable connected to the laptop, which is feeding into it,” he says.

Five female suicide bombers 'blow themselves up' in Maiduguri

Six people including five female suicide bombers aged between 9 and 13, lost their lives during an attack in Maiduguri, Borno state earlier today. According to reports, the five girls who had bombs strapped on them were travelling in a group when they approached civilian vigilantes helping the Nigerian military fight Boko Haram.


 "Two of the girls detonated their explosives instantly and the rest fled the scene," Muhammad Kanar from the Nigeria Emergency Management Agency told the BBC Hausa service. The other three blew themselves up as they were being chased by security forces. One other person was killed and four wounded in the incident.

$1.1billion Fraud: British Judge questions Jonathan's integrity, stops Etete from getting N17 billion

A British Judge on Tuesday refused to release $85 million (N17 billion) to Malabu, a fraudulent company controlled by Nigeria’s former petroleum minister, Dan Etete.

In refusing to release the money to Malabu, Justice Edis of the Southwark Crown Court declared that he was not sure the administration of President Goodluck Jonathan acted in Nigeria’s interest when it approved the transfer of the money to Malabu.

“I cannot simply assume that the FGN which was in power in 2011 and subsequently until 2015 rigorously defended the public interest of the people of Nigeria in all respects,” the judge ruled.

PREMIUM TIMES had reported how the Jonathan administration controversially approved the transfer of $1.092 billion from Nigeria’s JP Morgan account in London to Nigerian accounts controlled by Malabu.

The money was paid by global oil giants, Shell and ENi, for Africa’s richest oil bloc, OPL 245.

The former Attorney General of the Federation, Mohammed Adoke, and the former Minister of State for Finance, Yerima Ngama, signed the documents approving the transfer to Malabu.

The fraudulent deal, shaded in various layers of corruption, has been condemned by Nigerians and international transparency advocates and is being investigated by authorities in four different countries.

The seized $85 million

The $85 million was seized at the request of Italian prosecutors who are also investigating the deal. The money was the last part of the OPL 245 largesse not yet distributed.

Sensing that the Muhammadu Buhari administration was yet to find its feet on international legal matters, Mr. Etete approached the British court and asked that the money be returned to him.

At a two-day hearing that started on November 23, Mr. Etete’s lawyers argued that there was no fraud in the deal and asked that the money be released to him.

While Mr. Etete argued that the money be released to him, the Italian prosecutor argued that “their investigation could lead to a potential forfeiture of the money down the road.” a source who has followed the case and was present at the proceedings told PREMIUM TIMES.

Malabu’s lawyers told the court that freezing the money was an assault on Nigeria and questioned how the court could imagine that Messrs. Adoke and Ngama would be a party to a corrupt deal.

The ruling

While giving his ruling on Tuesday, Justice Edis said while he could not say for certain if the deal was fraudulent pending conclusions of investigations, it would be inappropriate to release the money to Malabu.

“I am not making any findings of fact about misconduct by anyone. I am simply assessing the evidence before me to determine whether a restraint order should be discharged which was granted by way of MLA (Mutual Legal Assistance between the UK and Italy) to support an investigation by the Italian authorities,” the judge said.

The judge also made reference to evidence provided by the Italian authorities that ex-President Jonathan was directly involved in the fraudulent deal.

“The suggestion from the wiretaps is that “Fortunato” was implicated and I am told that this was a reference in code (not subtle) to the former President of Nigeria, President Goodluck Jonathan,” the judge said.

“Aliyu (Abubakar) is said to be associated with him and Aliyu received, in a way which was not transparent, $523m of the money paid for the OPL 245 licence in August 2011.”

PREMIUM TIMES had reported how fictitious companies owned by Abubakar Aliyu, a man referred to as ‘Mr. Corruption’ by anti-graft officials, received over half ($532 million) of the total $1.092 billion.

Mr. Aliyu, a close ally of Mr. Jonathan was recently quizzed by EFCC operatives for the first time despite being a central character in the deal whose investigation was virtually stalled during the Jonathan presidency.

Activists react

Reacting to the ruling, Simon Taylor of Global Witness stated that “Given the gathering pace of the EFCC investigation in Nigeria under new leadership and a call by the Nigerian House of Representatives to cancel the deal in 2014, investors in Shell and Eni should demand to know why they were exposed to such risk.”

The UK based Global Witness has been at the forefront of the demand for transparency in the deal and other similar deals across the world.

Also reacting to the judgement, Dotun Oloko, an anti-corruption campaigner in Nigeria said, “In light of these allegations in a UK court, the role of the senior Nigerian officials involved in this deal, including Goodluck Jonathan, must now be fully investigated.”

With the ruling, Nigerian now has the opportunity to not only claim the money but also another $110.5 million of the funds held in a Swiss bank while investigations continue.

Court refuses to unfreeze funds from “smash and grab” raid on Nigerian oil block
Prosecutors allege that “fronts for President Goodluck Jonathan of Nigeria” received US$523m in proceeds of “smash and grab” OPL 245 deal

Southwark Crown Court today rejected an attempt by a company owned by the former Nigerian oil minister Dan Etete to unfreeze US$85m in proceeds of the corrupt deal for the Nigerian offshore oil block, Oil Prospecting Licence 245 (OPL 245), which was sold to Shell and Eni for $1.1bn in 2011.

The funds were restrained at the request of Italian authorities, who are investigating the sale of the block by Malabu Oil & Gas, a company secretly owned by Mr Etete, to the international oil companies.

The Federal Government of Nigeria (FGN) under Goodluck Jonthan acted as a middleman in the deal, and the court received evidence based on wiretaps that prosecutors allege show that the then President, Goodluck Jonathan, was directly involved. The deal deprived the Nigerian people of a sum equivalent to 80% of the country’s 2015 health budget.

“In light of these allegations in a UK court the role of the senior Nigerian officials involved in this deal including Goodluck Jonathan must now be fully investigated,” said Dotun Oloko, a Nigerian anti-corruption campaigner.

Evidence from US authorities presented to the court and included in the judgement “shows payments following circuitous routes which total $523m and which arrived at Abubakar Aliyu, aka ‘Mr Corruption’” […] “Aliyu’s companies are allegedly fronts for President Goodluck Jonathan of Nigeria”. The Crown Prosecution Service, acting at the behest of the Public Prosecutor for Milan (PPM), described OPL 245 as a case of “grand corruption”.

The OPL 245 deal is currently under investigation by the Public Prosecutor of Milan, the UK’s National Crime Agency (NCA), and the Nigerian Economic and Financial Crimes Commission (EFCC). The EFCC have reportedly recently interviewed Abubakar Aliyu in connection with the case, and earlier this year interviewed Dan Etete.

Justice Edis of Southwark Crown Court turned down Malabu’s application to discharge the freezing order rejecting Malabu’s arguments that the Crown had failed to follow proper procedures in securing the freezing. Justice Edis concluded in his judgement:

It is extremely important that what I am about to say is not misunderstood. I am not making any findings of fact about misconduct by anyone. I am simply assessing the evidence before me to determine whether a restraint order should be discharged which was granted by way of MLA to support an investigation by the Italian authorities. That investigation is not complete (and appears to be still at quite an early stage). What misconduct it may ultimately prove, if any, will be a matter for the PPM and the Italian court if proceedings are brought. However, precisely because I cannot reach firm factual conclusions, I cannot simply assume that the FGN which was in power in 2011 and subsequently until 2015 rigorously defended the public interest of the people of Nigeria in all respects. Mr. Fisher QC who appeared for the CPS used the phrase “grand corruption” to describe the form of corruption in which the state itself is culpable. The suggestion from the wiretaps is that “Fortunato” was implicated and I am told that this was a reference in code (not subtle) to the former President of Nigeria, President Goodluck Jonathan. Aliyu is said to be associated with him and Aliyu received, in a way which was not transparent, $523m of the money paid for the OPL 245 licence in August 2011.

“Given the gathering pace of the EFCC investigation in Nigeria under new leadership and a call by the Nigerian House of Representatives to cancel the deal in 2014, investors in Shell and Eni should demand to know why they were exposed to such risk,“ said Simon Taylor, a Director of Global Witness.

Suspects named in the Italian case include Eni and its current and former CEOs Claudio Descalzi and Paolo Scaroni, as well the company’s Chief Development, Operations & Technology Officer Roberto Casula and former executive Vicenzo Armanna. Other suspects in the Italian case include Dan Etete and middlemen Emeka Obi, Gianluca Di Nardo and Luigi Bisignani. Shell and Eni have denied any wrongdoing.

“It is clear from evidence in the public domain that high level executives in Shell personally took part in negotiating this deal. Citizens in the UK, US, Netherlands and Nigeria should demand that Shell and its executives are investigated in their respective countries,” said Nicholas Hildyard of The Corner House.

Shell and Eni have invested at least $1.8bn in purchasing and developing the block, which they own 50-50. It reportedly holds probable reserves of 9.23 billion barrels of oil, which if proven, would represent the equivalent of a third of Shell’s proven reserves, and two thirds of Eni’s.

Antonio Tricarico of Re:Common said: “$85 million paid by Eni and Shell for the benefit of Dan Etete’s company Malabu remains frozen in London. The time has come that Eni and Shell come clean about what they knew about this deal and who else this money was intended for.”

The National Association of Nigerian Students (NANS), has described as fraudulent and disgraceful the Honorary Doctorate Degree Conferred on President Muhammadu Buhari on Saturday by the Kaduna State University (KASU).
President of the students’ body, Comrade Tijani Usman, said “it is quite unfortunate that at a time we are clamoring for a overhaul (sic) and repositioning of our educational sector, our leaders are doing the opposite by their actions and inactions.

“The show of shame that took place in Kaduna State University (KASU) on 12 December, 2015, is capable of making foreign Universities and corporate organizations to further undermine and disregard degrees obtained from Nigerian schools.



“We expect our leaders to be our role models by living exemplary life. How can one explain that, President Muhammadu Buhari who has not even cleared the air on his certificate saga, still went ahead to accept a fraudulent honorary degree from a university that is not authorized by National Universities Commission (NUC) to do so.”

Usman said “the honorary doctorate degree conferred on President Buhari is illegal and non sequitur because,” stressing that the “KASU is not among the 22 universities accredited by NUC to award honorary degree.

“KASU was established 10 years ago, and has never graduated a PhD student.

3”Section 2.0 subsection (a) of the Council of VCs Keffi declaration 2012, prohibits the award of honorary degrees to persons holding political offices.”

The NANS demanded that “President Muhammadu Buhari should honorably relinquish the fraudulent degree.

“That NUC should with immediate effect sanction KASU for contravening its rules and regulations.

“That Academic Staff Of Universities (ASUU) and Senior Staff Association of Nigerian Universities (SSANU) should sanction the entire management team of KASU for making a mockery of Nigerian universities.

“That President Buhari should desist from procuring fraudulent degrees and focus on governance because, our country is faced with terrorism, economic hardship, religious crises and political tension.

DSS Agents Kill Policeman In Cold Blood

There is growing tension in Ado Ekiti, the capital of Ekiti State, between policemen and officers of the Department of State Services after two cops were shot on the premises of the DSS in Ado Ekiti, leading to the death of one of them.
It was gathered that the policemen, Sergeant Sylvester Malik and Corporal Mough Tergwu, were serving at the Special Protection Unit of the Nigeria Police Force in Lokoja, Kogi State.....

Sources told our PUNCH that the policemen were attached by the SPU to a former Executive Secretary of the National Health Insurance Scheme, Dr. Femi Thomas.

It was learnt that the DSS officers had stormed Thomas’ house in Ado Ekiti on Tuesday in three Hilux vehicles to invite the former executive secretary to their office in the state capital.
One of the sources said,
“It was Sylvester that even opened the gate for them. Once they made their intention known, the man (Thomas) agreed to follow them.”

The former executive secretary, it was learnt, followed the DSS officers in his Highlander, with number plate, FCT 408 ABJ.The two policemen were also said to have accompanied Thomas to the DSS office.
Trouble, however, started on the premises of the DSS after some of its officials complained that the policemen were armed.It was gathered that during an argument, the policemen were shot.
A source said the policemen offered to stay outside, that they could not hand over their firearms to the DSS men.

He said,
“Nobody knew what transpired afterwards, but suddenly there were sounds of gunshots and soon after, the two policemen were lying in a pool of blood. The policemen did not quarrel with them, so I don’t know what happened. Malik was shot thrice in the stomach. It was a real mess.”
It was learnt that Malik died immediately while Tergwu was rushed to the Ekiti State University Teaching Hospital. Malik’s remains were also taken to the hospital’s morgue.
The spokesperson for the police in the state, Mr. Alberto Adeyemi, said the command was aware of the incident, adding that investigation was ongoing.

He said,
“We have already sent out SITREP to the Force headquarters in Abuja. As soon as we heard, the Deputy Commissioner of Police on ground, and the AC OPS went to the DSS office. They confirmed that two policemen were shot on the premises of the DSS. One died, while the other one is still receiving treatment. We have told the DSS to hand over the officers responsible for the shooting to the police. ”
The Force spokesperson, ACP Olabisi Kolawole said, “The culprits will be prosecuted.”

Dokpesi Demands Solitary Confinement Against Assasination Plot By Tinubu-Wazobia

Indications emerged that detained owner of African Independent Television (AIT), Raymond Dokpesi, has raised alarm over suspected plot of assassination by the national leader of All Progressive Congress (APC) and former governor of Lagos State, Asiwaju Bola Tinubu.
AIT, a Lagos based media outfit, was responsible for a documentary which exposed the alleged atrocities, embezzlement and gross misappropriation of funds by the former governor of the state, Bola Tinubu, ahead the 2015 general elections in the country.
According to our source at Kuje Prison in Abuja, the prison official had kept Dokpesi in an undisclosed apartment within the premises of the prison.

Mr. Dokpesi, who arrived at Kuje Prison at about 4:55 p.m on Monday, was meant to be held in the prison pending the time his bail conditions shall be met.
"I've been granted conditional bail by Justice Gabriel Kolawole, but he said I should be remanded in prison until the conditions are fulfilled," Dokpesi explained.

He alleged that Tinubu had earlier negotiated the transfer of some of his boys in Ikoyi Prison down to Kuje Prison on a mission to terminate his (Dokpesi)'s life untimely.
"We are all Nigerians. I couldn't believe why inmates were joyous and exhilarated upon sighting me in the prison. The unusual even baffled the officer-in-charge.

"That my owned TV station aired documentary against the person of Tinubu ought not to be his justification to terminate my life. I am a business tycoon," Dokpesi said.
Splash reporter disclosed that, even though Mr. Dokpesi seemed downtrodden when he was brought into the prison, he regained his courage immediately he saw the jubilation coming from the inmates.
The reputable business tycoon is standing trial on a six-count charge of money laundering and other fraud-related crimes.

He was alleged by prosecutors that he received N2.1 billion from former National Security Adviser (NSA), Sambo Dasuki, in order to air presidential campaign material for former President Goodluck Jonathan of the Peoples Democratic Party (PDP).

Mr. Dokpesi is standing trial alonside his firm, DAAR Investment and Holdings Ltd, corporate owners of AIT and Raypower FM, a radio station.
"I still don't know where our freedom of speech in this country shall be before the end of this semi-military administration of the APC; either extinction or extant," Dokpesi lamented.

Rivers state Gov. Wike Sacked By Tribunal

A five-man Court of Appeal panel sitting Abuja has upheld the ruling of the gubernatorial election tribunal in Rivers state. In a 110-page ruling delivered by Justice M.B. Dongban-Mensem the Court ruled that the election of Nyesom Wike did not conform with the electoral act. The Court has ordered a rerun in 90 days.

In delivering a final ruling the Court of Appeal decided all the seven issues raised by Governor Wike against in favour of Dakuku Peterside and the All Progressives Congress party.

The appellate court refused to discard the findings of a lower tribunal saying the number of witnesses is not the main issue but evaluation of the strength of evidence before the trial court. 

Issue one on fair hearing resolved for the APC candidate, Dakuku

The appellate court also stated it has evaluated the guidelines of the Independent National Electoral Commission and holds them sacrosanct.

The Court of Appeal said it agrees that gubernatorial election was marred by wide-scale violence.

On issue two regarding competence of ruling by the new chairman in the lower tribunal, stamps, issuance of service and jurisdiction, the court ruled it was in order.

On issue three about locus standing to institute the case at the tribunal in 21 days, the issue was again resolved in APC's favor.

The court described the People's Democratic Party (PDP) and its candidate, Wike as crying more than the bereaved

Issue four on INEC manuals, guidelines and non-compliance including non-issuance of pre-hearing notices by the chairman of the lower tribunal, court resolved in APC's favor saying it was immaterial.

Issue five is on the reliance on documentary evidence by the tribunal resolved for APC

On issue six as to whether the lower tribunal was right on card readers, the appeals court said in the evaluation of the evidence before the tribunal after a thorough analysis of the subject matter of card readers, and its use, the lead judge stated categorically that card readers guarantees credible elections.

The Court stated that INEC manuals were consistent with the provisions of electoral Act.

The Court then dismissed Wike's appeal on all grounds and ordered INEC to conduct a fresh governorship election in Rivers state within 90 days.

Obama Appoints Nigerian Adewale Adeyemo As Deputy National Security Adviser

President Barack Obama has tapped Adewale “Wally” Adeyemo, who served in top roles at the Treasury Department, to succeed Caroline Atkinson as his deputy national security adviser for international economic affairs.

Ms. Atkinson has served in her current post since June 2013, a position that includes coordinating U.S. participation in the annual summits of the Group of 20 and Group of Seven countries. Ms. Atkinson also played key roles in the recently concluded climate negotiations in Paris and in pushing the White House’s trade agenda, including the Trans-Pacific Partnership trade agreement.

Mr. Adeyemo, 34, joined the White House’s National Economic Council as deputy director this fall from the Treasury, where he served most recently as the deputy chief of staff to Secretary Jacob Lew. He was the Treasury’s lead negotiator on the currency agreement that was part of the Pacific trade deal.

Mr. Adeyemo also worked on Treasury’s response to crises in Ukraine and Greece and in 2010 was one of the first officials charged with standing up the Consumer Financial Protection Bureau.

In a statement, Mr. Obama thanked Ms. Atkinson for her service and said he was grateful that Mr. Adeyemo would carry on her work. Mr. Adeyemo had been nominated by Mr. Obama to serve as assistant Treasury secretary for international markets and development, but a White House official said Mr. Adeyemo had asked the president to withdraw the nomination given his new role.
Mr. Lew said that Mr. Adeyemo had “developed a network of international relationships in economic offices around the world to promote U.S. interests effectively.” Former Treasury Secretary Tim Geithner said Mr. Adeyemo, who joined the administration in 2009, was a “natural diplomat with a great feel for policy.”

The position has served as a springboard to even higher profile international finance posts. Michael Froman, who is currently the U.S. trade representative, held the post under both Mr. Obama and President Bill Clinton. Federal Reserve governor Lael Brainard, who previously served as a senior Treasury official in the Obama administration, held the post in the Clinton administration.

DSS drops charges against Nnamdi Kanu in Magistrate Court

Magistrate of the Chief Magistrate Court, Wuse Zone 2, Abuja, Shuaibu Usman, on Wednesday discharged the Director of Radio Biafra and Leader of the Indigenous People of Biafra (IPOB),  Nnamdi Kanu, on all counts of criminal conspiracy and ownership of an unlawful society brought against him by the federal government.
After holding that the government had dropped the charges against Kanu, the judge ruled:  “The accused person is hereby discharged and the case struck out.”
The government through its agent, the Department of State Services (DSS), had elected to withdraw the case at the lower court for a higher court, which has jurisdiction to entertain charges bordering on terrorism, to take over.
Usman was scheduled to deliver judgment on the application of the DSS on December 1, but he put it off until December 16, reports TheCable.
The DSS has held Kanu for at least 90 days despite an order of the magistrate court granting him bail in October.
After the lower court granted him bail, the DSS got an order of the federal high court, Abuja, to keep the leader of IPOB in detention.
However, his lawyer, Vincent Obetta, filed a counter application, seeking bail for the accused person.
Meanwhile, Justice of the Federal High Court, Abuja, Adeniyi Ademola, is expected to rule on the bail application on Thursday.
Since, the arrest and detention of Kanu by Nigeria’s secret Police, in Lagos, on Saturday, October 17,  wave of protests, engineered by IPOB, as well as members of the Movement for the Actualization of Sovereign State of Biafra (MASSOB) had swept through the South-East and parts of the South-South, demanding an immediate and unconditional release of Kanu.

Dasuki Bought Assets In London And Dubai With Arms Cash - EFCC

The Economic and Financial Crimes Commission on Tuesday accused the immediate past National Security Adviser, Col. Sambo Dasuki (retd.), of compromising the security of the nation and committing economic sabotage through his alleged diversion of over N32bn meant for the purchase of arms to fight terrorists in the North -East.

The commission, which also gave more details about the alleged diversion of funds meant for the purchase of arms by the office of the NSA during Dasuki’s tenure, said there were documents showing that the ex-NSA gave the approval for the release of the funds to the accounts of private companies and individuals for the procurement of arms.

EFCC’s lawyer, Mr. Rotimi Jacobs (SAN), said this before Justice Yusuf Baba of the Federal Capital Territory High Court in Maitama, Abuja, while opposing the bail applications filed by Dasuki and his co-accused persons, who are being prosecuted on 19 counts of conspiracy, criminal breach of trust and dishonest misappropriation of the money.


The other accused persons, who had pleaded not guilty to all the 19 counts on Monday, are a former Director of Finance and Administration in the Office of the NSA, Shuaibu Salisu, and a former Director of the Nigerian National Petroleum Corporation, Aminu Baba-Kusa, and two companies.

The two companies, in which Baba-Kusa are their directors, are Acacia Holdings Limited and Reliance Referral Hospital Limited.

Jacobs, who said the accused persons were still under investigation for other “aspects of the case”, added that the EFCC was still tracing assets linked to the proceeds of the diversion of the funds.

The EFCC, however, alleged that Dasuki had purchased houses in London and Dubai with the proceeds of the funds meant for the purchase of arms for the soldiers battling the terror group, Boko Haram, in the North-East states.

The prosecution also alleged in its counter-affidavit that Dasuki transferred huge sums of money to companies whose identities were still being traced, adding that he transferred large sums of money outside Nigeria to acquire “several assets in Dubai and London.’’

Its counter-affidavit also read, “That our investigation also revealed that the applicant transferred large sums of monies outside Nigeria and he acquired several assets in Dubai and London with these funds.”

The defence lawyers, representing the accused persons – Ahmed Raji (SAN) for Dasuki, A. U. Mustapha for Salisu, and Solomon Umoh (SAN) for Baba-Kusa and his companies – had, while moving their respective bail applications, maintained that the charges filed before the court did not indicate that the money in question was meant for the procurement of arms.

But Jacobs, in picking holes in the lawyers’ contention, referred the judge to pages 14 to 58 of the prosecution’s proof of evidence, which he said contained documents detailing the approval of the former NSA for the release of various sums of money to individuals and private companies for the procurement of arms.

Jacobs said, “In our proof of evidence, we mentioned security money meant for purchase of arms. We also mentioned security equipment, but they decided not to look at it.

‘‘Page 14 to page 58 of our proof of evidence showed approval for the supply of security equipment, satellite and arms. All the charges we filed were based on funds approved for the purchase of arms.”

In a counter-affidavit, deposed to by an EFCC detective, Hassan Saidu, the anti-graft agency alleged that the funds were released to private companies and individuals “who have nothing to do with the supply of security equipment or rendering security services”.

According to the 19 charges preferred against the accused persons, Dasuki, Salisu and Senior Special Assistant, Domestic Affairs to the President, Waripamowei Dudafa, released N10bn to the Peoples Democratic Party for the presidential primary delegates.

It was also alleged that N2.1bn was paid into the account of DAAR Investment and Holding Company Limited, controlled by one Dr. Raymond Dokpesi for the funding of media activities for the 2015 Presidential Election Campaign for the PDP.

The sum of N1.45bn was also allegedly paid to Acacia Holdings Limited, controlled by Baba-Kusa, to organise prayers.

Again, the sum of N750m was allegedly paid to Reliance Referral Hospital Limited in favour of Baba-Kusa for prayers.

Belsha Nigeria Limited, controlled by Bello Matanwalle, was also said to have received N380m to support some members of the House of Representatives for their re-election campaign.

General Hydrocarbons Limited controlled by Thisday publisher, Nduka Obaigbena was also said to have received N670m for “energy consulting”.

The office of the NSA was also said to have paid N260m to a former Minister of Works, Chief Tony Anenih, who was also the Chairman of the PDP Board of Trustees, during the March 28 presidential election.



Senator Iyorchia Ayu was also said to have received N345m for the construction of shopping mall at Jabi, Abuja, purporting the said sum to be payment for satellite charges and security equipment.

EFCC said in its counter-affidavit that it was in the interest of the accused persons to remain in protective custody in order to shield them from being attacked by relatives of innocent soldiers who were drafted to fight Boko Haram without sufficient equipment.

The affidavit read in part, “That the charges being alleged against the defendant/applicant (Dasuki) border on economic sabotage that strikes at the very foundation of Nigeria well-being and existence.

“That it is in the interest of justice to put the applicant in protective custody so as to shield him from a possible attack by the relatives of the innocent soldiers, who lost their lives due to lack of adequate equipment; innocent soldiers who lost their lives due to lack of adequate facilities caused by the diversion of the funds meant for that purpose.

“Apart from the cases that are pending against the applicant, he’s also being investigated in respect of other criminal allegations.”

Jacobs said during the hearing that “investigation into other aspects is still ongoing. There is still investigation into assets tracing.”

He urged the court not to grant bail to Dasuki, whom he said “will escape from the jurisdiction of the honourable court from Nigeria”, adding that “the applicant will not be available to stand trial if released on bail.”

In moving their separate applications for bail, the defence counsel urged the court not to rely on the proof of evidence filed by the prosecution, arguing that doing so would run contrary to the presumption of innocence, which their clients were entitled to under the Constitution.

They maintained that the allegation that their clients would interfere with the prosecution witnesses was speculative.

They added that the provisions of Section 162 of the new Administration of Criminal Justice Act had placed the onus on the prosecution to prove why bail, which, according to them, is “almost automatic” for the accused persons, should not be granted to them.

Raji said, “The prosecution has made strenuous attempt to rely on the proof of evidence in urging your lordship not to grant bail.

“It is my argument that to rely on proof of evidence will violate the principle of presumption of innocence because they have not been tested.”

Raji urged the court to grant bail to Dasuki on condition of self-recognition and seizure of his passport as granted to him by Justice Adeniyi Ademola of the Federal High Court in Abuja, where the accused person is being prosecuted for illegal possession of firearms and money laundering.

Justice Baba has adjourned ruling on the bail application till Friday.

Meanwhile, the EFCC on Tuesday arraigned a former Minister of State for Finance, Bashir Yuguda; a former Governor of Sokoto State, Attahiru Bafarawa; his son, Sagir Attahiru; and their firm – Dalhatu Investment – on 22 counts of misappropriation of about N13bn meant for the purchase of arms by the Office of the NSA.

Also arraigned along with them, before Justice Peter Affen of the same FCT in Maitama, are Dasuki and Salisu.

The accused were said to have misappropriated the money between August 2013 and May 7, 2015.

All the accused were arraigned before Justice Peter Affen, who had, on Monday, granted leave to the EFCC to prefer the charges against the accused persons.

They pleaded not guilty to 22 counts of conspiracy, dishonest receipt of stolen property in breach of sections 97 and 317 of the Penal Code Act as well as receipt of proceeds of criminal conduct in breach of Section 17(b) of the EFCC Act.

After the arraignment on Tuesday, Justice Affen fixed Wednesday for hearing of the accused persons’ bail applications.

Bomb Scare Rocks Ebonyi NYSC Cam

The end-of-camping parade for the 2015 Batch B stream two National Youth Service Corp, (NYSC) members deployed to Ebonyi State was Wednesday put off following a bomb scare at the camp ground.
The parade was scheduled for the Old McGregor College orientation camp Afikpo, Afikpo North Local Government Area of the state.

But there was then panic and tension at the camp ground when security operatives raised the alarm of suspected explosive device in the orientation camp which prompted corps members and officials of the scheme to scamper for safety.

The security operative attached to the camp ground combed the hostels of the corp members looking for a possible place the device was hidden.
A corps member said apprehension heightened in camp when some unknown faces were seen coming into the camp ground during the camp fire night.

Following reports by some corps members that unknown faces were seen entering Aso Rock Hostel, the security operatives had to searched thoroughly for the device in the hostels.
As panic spread at the camp ground, the leadership of the scheme hurriedly distributed posting letters to corps members to proceed to their places of primary assignments.

Police spokesperson for the state, George Okafor, who confirmed the development, said the camp ground was safe as no bomb device was found by the anti-bomb squad deployed to the orientation camp.

He disclosed that a cable was found which he said was being screened by the anti-bomb squad.
He added that security had been beefed up in camp ahead of the posting of another batch of corp members to the state.

The Chairman of NYSC governing board, who is also the Ebonyi State Commissioner for Sports, Charles Akpuenika, said he got a call from a security agency in the state alerting him on the bomb scare.

He said he immediately alerted Governor Dave Umahi who ordered that the terminal parade be called off.

Mr. Akpuenika said, “I got a call from a security agency in the state that briefed me on what was happening at the camp ground and the panic the bomb scare created among corps members”.
“I immediately placed a call to the Governor, he ordered that the terminal parade be called off. The governor is so interested in the safety of every Ebonyi indigene and visitors to the state. He would not desire that anybody be hurt and that was why it was called off.

“Actually, from the information I got from the security agency, a cable allegedly usually used to construct bomb was discovered by the security agency at the camp ground.

“The cable has been taken by the anti-bomb squad and I believe that they would be in a better position to inform us if the cable was actually intended to be used by some miscreants to construct bomb in the area.

“Ebonyi is a safe ground for visitors, there has never been any fear of terror attack in the state and we don’t hope to have one. People should feel free to come to the state and there security is assured.”

Our attention has been drawn to reports making the rounds, especially on internet-based media, that President Muhammadu Buhari received $300,000.00 and up to five armoured SUVs from the Office of the National Security Adviser in the aftermath of the attack on his convoy in Kaduna last year. We unequivocally deny that President Buhari received $300,000.00 or any monetary compensation whatsoever from the Jonathan Presidency or any of its officials, in the aftermath of that attack, or at any other time since then.
While it is true that one armoured SUV and one untreated SUV were sent to the President in the aftermath of the attack, the vehicles were in keeping with his entitlements as a former Head of State under the Remuneration of Former Presidents and Heads of State (And other Ancillary Matters) Decree of 1999. Section 3, Sub Section 1 of that Decree provides that three vehicles will be provided for former heads of state and replaced every four years. There was therefore nothing untoward, illegal or tending to corruption in former Head of State Buhari and Presidential aspirant, as he then was, receiving vehicles, to which he was statutorily entitled , from the Federal Government of Nigeria. President Buhari had in keeping with his austere, spartan and frugal disposition shunned most of his entitlements as a former Head of State, but was prevailed upon by his supporters to accept the two vehicles for his personal safety in the aftermath of the dastardly attempt to assassinate him. It is preposterous to think that the President will allow his acclaimed reputation of honesty and incorruptibility to be tarnished by accepting a questionable monetary compensation from a discredited regime.
